Terms of Service

1. Agreement to Terms

Welcome to LNDLI. By creating an account, listing an item, booking a rental, or otherwise using the LNDLI platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

LNDLI is operated by LNDLI LLC, a Texas limited liability company ("LNDLI," "we," "us," or "our"). LNDLI is a peer-to-peer rental marketplace that connects people who want to rent items ("Renters") with people who own items available for rent ("Owners"). LNDLI itself does not own, lease, operate, inspect, or take custody of any listed item, and is not a party to the rental agreement between a Renter and an Owner.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use LNDLI. By using the Service, you represent that you meet these requirements and that any information you provide is true, current, and complete.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@lndli.com if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms, post fraudulent listings, fail to pay platform fees, or otherwise misuse the Service, with or without notice.

4. Listings & Bookings

Owners are responsible for accurately describing their items, including condition, availability, and any pickup or usage restrictions. Renters are responsible for using rented items as described and returning them in the same condition (normal wear and tear excepted).

All Renters must keep a valid payment card on file to book, regardless of whether they pay through LNDLI Pay or arrange a Personal Transaction. Some Owners may require Renters to complete identity verification before booking certain (typically higher-value) items.

A booking is a binding agreement between the Renter and Owner. LNDLI facilitates the transaction but is not a party to the rental agreement itself. See our Rental Agreement for the standard terms that apply between Renters and Owners.

5. Fees, Payments & Deposits

LNDLI charges a platform fee on each rental:

  • LNDLI Pay (online payment): 10% of the total rental price, deducted automatically from the Owner's payout.
  • Personal Transaction (off-platform payment): 12% of the total rental price, charged to the Renter's card at the time of booking. The Renter then settles the rental amount with the Owner directly. If the Owner declines the booking, this fee is refunded to the Renter.
  • Minimum platform fee: a minimum fee of $1.50 applies to either fee type. On rentals where the percentage would be less than $1.50, the $1.50 minimum is charged instead.

For LNDLI Pay bookings, the Renter pays the listed rental price and LNDLI's fee is deducted from the Owner's payout — not added to the Renter's total. For Personal Transactions, LNDLI's service fee is charged to the Renter at booking as described above, and the Renter arranges the rental payment with the Owner directly.

Payments are processed by Stripe. By using LNDLI, you also agree to Stripe's Connected Account Agreement where applicable.

Held payments (LNDLI Pay). For LNDLI Pay bookings, the Renter's payment — the rental price plus any refundable deposit — is held and released to the Owner only after the Renter confirms the item has been returned. If a booking is declined or cancelled before it completes, the held amount is refunded to the Renter. LNDLI is not a bank, escrow agent, or money transmitter; all funds are held and settled by our payments processor, Stripe, under its Connected Account Agreement.

Refundable deposits. Owners may set an optional refundable security deposit on a listing. For LNDLI Pay bookings, the deposit is collected from the Renter at checkout and held alongside the rental. After the rental, the Owner has a short inspection window to either release the deposit (refunded in full to the Renter) or file a damage claim against it (see Section 8). Deposits do not apply to Personal Transactions, which the Renter and Owner settle directly.

6. Cancellations & Refunds

Renters may cancel a booking request before the Owner confirms it. After a booking is confirmed, the Renter and Owner should arrange any cancellation directly; if you need help, contact support@lndli.com.

If an Owner declines a booking after a Renter has paid via LNDLI Pay, the Renter is automatically refunded in full (including any deposit).

If a rental cannot be completed due to misrepresentation by the Owner, LNDLI may issue a refund at its discretion after review.

7. Prohibited Conduct

You agree not to:

  • List illegal items or items you do not own / have authority to rent
  • Use the Service to harass, defraud, or harm other users
  • Circumvent platform fees by arranging payment off-platform without using the Personal Transaction option
  • Post false reviews or manipulate the rating system
  • Reverse-engineer, scrape, or attack the Service

Prohibited items. You may not list or rent through LNDLI:

  • Motor vehicles of any kind — cars, motorcycles, trucks, scooters, mopeds, boats, ATVs, or RVs
  • Firearms, ammunition, weapons, or explosives
  • Recalled, counterfeit, stolen, or unsafe products
  • Alcohol, tobacco, vaping products, cannabis, drugs, or drug paraphernalia
  • Hazardous materials, or medical/safety devices that require licensing to supply
  • Live animals, or any item whose rental is restricted or illegal under applicable law

8. Damage, Loss, Claims & Protection

Renters are financially responsible for damage to or loss of rented items beyond normal wear and tear. Both parties are strongly encouraged to document the item's condition with photos at handoff and at return — these timestamped photos are the primary evidence used to resolve a claim.

Deposit claims. Where a refundable deposit was held (LNDLI Pay), the Owner may file a damage claim against that deposit during the inspection window. A claim must include photo evidence. The Renter is notified and may either accept the claim (the claimed amount is paid to the Owner and the remainder refunded to the Renter) ordispute it. A disputed claim freezes the deposit and is submitted to LNDLI for review.

Mediation. When LNDLI reviews a disputed claim, it may consider the handoff and return photos, messages, and account history. LNDLI decides how a disputed deposit is split. LNDLI's decision is made in good faith but LNDLI does not guarantee any particular outcome, and final responsibility for damages rests with the parties to the rental.

LNDLI Protection. For eligible LNDLI Pay rentals, if an Owner suffers a verified loss (e.g. theft or damage) that exceeds the held deposit, the Owner may apply to the LNDLI Protection fund. Protection is adiscretionary reserve funded by LNDLI from which we may, at our sole discretion and after review, reimburse the Owner up to a per-rental coverage cap. Protection applies to LNDLI Pay rentals only, is not insurance, and does not relieve the Renter of responsibility for a loss they caused.

9. Disclaimers

The Service is provided "as is." LNDLI makes no warranties of any kind, express or implied, regarding the Service, listed items, user conduct, or any rental outcome. We do not verify the condition, authenticity, safety, or legality of listed items.

10. Limitation of Liability

To the maximum extent permitted by law, LNDLI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, lost data, or property damage. LNDLI's total liability for any claim shall not exceed the fees we have collected from you in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless LNDLI from any claims, damages, or expenses arising from your use of the Service, your listings, your rentals, or your violation of these Terms.

12. Assumption of Risk & Release

Rented items may include tools, equipment, and other products that carry inherent risks. You use rented items at your own risk. You are solely responsible for inspecting an item before use, determining it is safe and suitable for your intended purpose, using appropriate safety equipment, and complying with all instructions and laws.

Because LNDLI does not own, inspect, or control listed items and is not a party to any rental, you release LNDLI and its owners and employees from any claims, injuries, losses, or damages arising out of or relating to the condition or use of a rented item, the acts or omissions of any other user, or any dispute between users. If you are a California resident, you waive California Civil Code § 1542 with respect to this release.

13. Taxes

You are responsible for determining, collecting, reporting, and remitting any taxes that apply to your rentals or earnings, including any applicable sales, use, or rental taxes. Where required by law, LNDLI or its payments processor may report amounts paid to Owners to tax authorities (for example, via IRS Form 1099-K) and may request tax information from you.

14. User Content & Intellectual Property

You retain ownership of the photos, listing text, reviews, and other content you submit ("User Content"). By submitting User Content, you grant LNDLI a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and use it to operate, improve, and promote the Service. You represent that you own or have the rights to your User Content and that it does not infringe others' rights.

LNDLI respects intellectual-property rights. If you believe content on the Service infringes your copyright, email support@lndli.com with the details required by the DMCA. We may remove infringing content and terminate repeat infringers.

15. Dispute Resolution, Arbitration & Class-Action Waiver

Most concerns can be resolved quickly — please contact us first at support@lndli.com before starting a formal proceeding.

Binding arbitration. Except for small-claims matters and claims for injunctive relief, any dispute arising out of or relating to these Terms or the Service shall be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Collin County, Texas.

Class-action waiver. You and LNDLI agree to bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

30-day opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@lndli.com with your name, account email, and a statement that you opt out.

Governing law. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any claim that proceeds in court shall be brought in the state or federal courts located in Collin County, Texas.

16. General

If any provision of these Terms is held unenforceable, the remaining provisions stay in effect. These Terms are the entire agreement between you and LNDLI regarding the Service and supersede prior agreements on the subject. You may not assign these Terms; LNDLI may assign them to an affiliate or successor. Sections 8–15 survive termination. LNDLI is not liable for failures or delays caused by events beyond its reasonable control. You consent to receive notices and agreements electronically.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via email or an in-app notice. Continued use of the Service after a change constitutes acceptance of the updated Terms.
